Common use of Tenant's Attornment Clause in Contracts

Tenant's Attornment. Tenant covenants and agrees that, if by reason of a default upon the part of Landlord herein in the performance of any of the terms and conditions of any Mortgage, and the estate of Landlord thereunder is terminated by summary dispossession proceedings or otherwise, Tenant will attorn to the then Lender or the purchaser in such foreclosure proceedings, as the case may be, and will recognize such Lender or such purchaser as the Landlord under this Lease. Tenant covenants and agrees to execute and deliver, at any time and from time to time, upon the request of Landlord or of any Lender or the purchaser in foreclosure proceedings, any instrument which may be necessary or appropriate to evidence such attornment. Tenant further waives the provisions of any statute or rule of law now or hereafter in effect which may terminate this Lease or give or purport to give Tenant any right of election to terminate this Lease or to surrender possession of the Property in the event any such proceedings are brought against Landlord under such Mortgage or by any Lender, and agrees that this Lease shall not be affected in any way whatsoever by any such proceedings.

Tenant covenants and agrees to execute and deliver, at any time and from time to time, upon the request of Landlord or of any Lender Mortgagee or the purchaser in foreclosure proceedings, any instrument which that may be necessary or appropriate to evidence such attornment. Tenant further waives the provisions of any statute or rule of law now or hereafter in effect which that may terminate this Lease or give or purport to give Tenant any right of election to terminate this Lease or to surrender possession of the Property Demised Premises in the event any such proceedings are brought against Landlord under such Mortgage or by any LenderMortgagee, and agrees that this Lease shall not be affected in any way whatsoever by any such proceedings.
