Tenant’s Duties. The Tenant shall: A. Keep the Premises that the Tenant occupies and uses safe and sanitary; B. Dispose of all rubbish, garbage, and other waste in a clean, sage and sanitary manner approved by the Landlord; C. Promptly notify the Landlord of the need for repairs; I. Conduct the Tenant’s self and require other persons on the Premises with the Tenant’s consent to conduct themselves in a manner that will not disturb the Tenant’s neighbors’ “peaceful enjoyment” of the Premises; J. Not unreasonably withhold consent for the Landlord or the Landlord’s agents to enter the Premises; K. Conduct the Tenant’s self, and require persons in the Tenant’s household and persons on the Premises with the Tenant’s consent to conduct themselves, in connection with the Premises so as not to violate the prohibitions contained in Chapters 2925, and 3719, of the Revised Code, or in municipal ordinances that are substantially similar to any section in either of those chapters, which relate to controlled substances; L. The Tenant shall regularly test all smoke detectors, supply electric current thereto (battery or electric current if required by lease), and notify the Landlord of any mechanical failure, need for repair, or replacement.

C. (g) Keep drains that are in or adjacent to Premises clean and unobstructed;
(h) Keep all plumbing fixtures in clean and provide and use a plunger for clearing toilet drains; Xxxxxx agrees that should Landlord have to clear a toilet drain the Premises charge will be $55.00 during office hours and
(i) Provide and install shower curtains and bath mats for all tubs and showers to prevent water damage. Any damages resulting from the improper installation or used by the Tenant as clean as their condition permitsuse of mats and shower curtains will be charged to Tenant;
D. (j) Use in a reasonable manner all electrical, plumbing, sanitary, heating, ventilating, air conditioning and operate all electrical other facilities and plumbing fixtures properlyappliances. Tenant shall be responsible for notifying Landlord of any maintenance concerns in a timely manner. Failure to do so could result in Tenant being responsible for any additional utility costs and/or damages resulting from the unreported problem;
E. Comply with (k) Promptly vacate Premises at the requirements on termination of the Tenants Rental Agreement, whether by all applicable state and local housing, health and safety codesexpiration of the rental term or resulting from default of Tenant;
F. Personally refrain, and forbid any other person who is on the Premises with the Tenant’s permission, from intentionally or negligently destroying, defacing, damaging, or removing any fixture, appliance or, other part of the Premises;
G. Maintain in good working order and condition any range, refrigerator, washer, dryer, dishwasher, or other appliances supplied by the Landlord;
H. Promptly notify the Landlord of the need for repairs;
I. (l) Conduct the Tenant’s self and require other persons on the Premises with the Tenant’s consent to conduct themselves oneself in a manner that will not disturb the Tenant’s 's neighbors’ “peaceful enjoyment” , and require any person on Premises to conduct himself in a manner that will not disturb Tenant's neighbors’ peaceful enjoyment;
(m) Be responsible for the actions and damages caused by any invited or uninvited guests who may enter Landlord’s property as a result of Xxxxxx’s hosting a party or gathering at the Premises;
J. Not unreasonably withhold consent for (n) Abide by all reasonable rules and regulations issued by Landlord and ensure that Xxxxxx's guests and Occupants also abide by said Rules and Regulations and the Landlord or the Landlord’s agents provisions of paragraph 15 above;
(o) Replace all reasonably accessible burned out light bulbs, including exterior light fixtures adjacent to enter the Premises;
K. Conduct (p) Keep thermostat set above 55 degrees to prevent freezing of pipes. Xxxxxx agrees to allow
(q) Use the provided ladder and/or loft or mezzanine area, if any, in a safe manner and assume all risks for using them;
(r) Provide Landlord with keys and/or instructions on how to operate any new burglary prevention or fire detection devices that have been installed by Tenant’s self. Upon termination of tenancy, if required by Landlord, Tenant shall remove all such devices and repair all damages;
(s) Remove snow and/or ice, as needed, in order to move vehicle from parking space. Tenant shall also be responsible for snow and/or ice removal from pathways, sidewalks, and require persons driveways unless Premises is located in an apartment or condominium complex where these services may be provided by Landlord;
(t) Cover a minimum of 75 percent of wood floors, including hallways and corridors, with area rugs and sweep, dust, and appropriately protect and maintain any hardwood floors throughout the Tenant’s household term of this Rental Agreement to protect them against scratches; and
(u) Keep the Premises free from insects and persons on pests, as those are defined in Virginia Code §3.2-3900, and promptly notify Landlord of the existence of any insects or pests.
(w) Secure at all times any firearm(s) in the Premises with either a trigger lock or similar device or store the Tenant’s consent to conduct themselves, firearm(s) in connection with the Premises so as not to violate the prohibitions contained in Chapters 2925, and 3719, of the Revised Code, or in municipal ordinances that are substantially similar to any section in either of those chapters, which relate to controlled substances;
L. The Tenant shall regularly test all smoke detectors, supply electric current thereto (battery or electric current if required by lease), and notify the Landlord of any mechanical failure, need for repair, or replacementa locked gun safe.

Tenant’s Duties. The Tenant agrees that it shall during the Term: ---------------
(a) Not use or occupy the Premises in violation of law or of the certificate of occupancy issued for the Building, and shall:, upon written notice from Landlord, discontinue any use of the Premises which is declared by any governmental authority having jurisdiction to be a violation of law or of said certificate of occupancy. Tenant shall comply with any direction of any governmental authority having jurisdiction which shall, by reason of the nature of Tenant's use or occupancy of the Premises, impose any duty upon Tenant or Landlord with respect to the Premises or with respect to the use or occupation thereof.
A. (b) Give Landlord access to the Premises at all reasonable times, upon reasonable advance notice to Tenant (which notice shall be directed to Tenant's "Facilities Department" in addition to any other person to whom notices are required to be given under this Lease), without charge or diminution of Rent, to enable Landlord to examine the same and to make such repairs, additions and alterations as are required under the terms of this Lease, including the right to show the Premises for the purpose of a potential sale or lease. If Tenant fails to respond to Landlord's request for access within one (1) business day, Tenant shall be deemed to have agreed to the time and manner of Landlord's requested access. If Landlord proposes to show the Premises, Tenant will be allowed to limit or prevent access to those portions of the Premises Tenant deems, in its sole business judgment, sensitive or confidential. Furthermore, if Landlord proposes to show the Premises to a prospective Tenant, Landlord may be precluded from doing so, except during the last six (6) months of the Lease term.
(c) Keep the Premises that the Tenant occupies in good order and uses safe condition, reasonable wear and sanitary;
B. Dispose of all rubbish, garbagetear and casualty damage excepted, and replace all broken glass with glass of the same quality as that broken, save only glass broken by fire and extended coverage type risks.
(d) Recognize that improvements attached to the Premises become the property of the Building and may not be removed without approval of Landlord which approval may be subject to the Tenant's paying for the cost of repairs resulting from the removal of such improvements.
(e) Upon the termination of this Lease in any manner whatsoever, remove Tenant's property and those of any other waste person claiming under Tenant, and quit and deliver up the Premises to Landlord peaceably and quietly in a cleanas good order and condition as the same are in on the Commencement Date, sage reasonable use and sanitary wear thereof, casualty damage and permitted alterations and additions not specifically required to be removed upon termination of the Lease as they were added excepted. The foregoing property required to be removed that is not removed by Tenant at the termination of this Lease, however terminated, shall be considered abandoned and Landlord may dispose of the same in the manner approved by it deems expedient with reasonable cost to be billed to the Landlord;Tenant.
C. Keep all plumbing fixtures in (f) Not place signs on the outside of the Premises or used in places visible from the outside by the public, without the prior written consent of Landlord and subject to all applicable governmental rules and restrictions, as well as the "Building Rules and Regulations as set forth in Exhibit "E".
(g) Not use or allow the Premises to be used for any unlawful purpose, nor cause, maintain or permit any nuisance in, on or about the Premises. Tenant as clean as their condition permits;shall not commit or suffer to be committed any waste in or upon the Premises.
D. Use (h) Not do or permit to be done anything which will invalidate or increase the cost of any fire, extended coverage or any other insurance policy covering the Building and/or property located therein unless Tenant agrees, after Landlord gives thirty (30) days prior written notice to Tenant of the cost thereof, to reimburse Landlord for any increase in the cost of such insurance and operate all electrical and plumbing fixtures properly;
E. Comply subject to lender's approval. Tenant shall promptly, upon demand, reimburse Landlord for any additional premium charges for such policy by reason of Tenant's failure to comply with the requirements on provisions of this Section.
(i) Observe the Tenants by all applicable state "Building Rules and local housing, health and safety codes;
F. Personally refrainRegulations" described in Exhibit "E", and forbid any other person who which may be modified by Landlord from time to time provided Tenant is on given at least ten (10) business days prior written notice of such now or amended rules and provided further that such new or amended rules do not materially interfere with the terms and conditions of this Lease or unreasonably interfere with Tenant's quiet enjoyment and its intended use of the Real Property, the Building or the Premises with or materially increase Tenant's cost of operations or occupying the Premises and, provided further, that the Building Rules and Regulations shall not discriminate against Tenant and are enforced by Landlord in a non-discriminatory manner.
(j) Notify Landlord in writing promptly upon Tenant’s permission, from intentionally or negligently destroying, defacing, damaging, or removing 's discovery of any fixture, appliance or, other part of latent defects in the Building and/or the Premises;
G. Maintain . So long as Tenant has promptly notified Landlord in good working order writing of any latent defect(s) (of which Tenant has knowledge) in the building shell construction and condition any rangethe Tenant Improvements owned by Landlord, refrigeratorthen Tenant shall not be responsible for the costs and expense of repairing latent defect(s) in the building shell construction and the tenant improvements owned by Landlord. Provided, washer, dryer, dishwasher, or other appliances supplied by the Landlord;
H. Promptly if Tenant fails to notify the Landlord of a latent defect of which Tenant has knowledge, then the need for repairs;

(e) Keep Premises in a clean and safe condition and immediately report any unsafe condition to Landlord;
(f) Remove from Premises all rubbishashes, garbage, rubbish and other waste in a clean, sage safe, and sanitary timely manner approved by and in compliance with applicable recycling requirements of Landlord or the LandlordCity of Charlottesville;
C. (g) Keep drains that are in or adjacent to Premises clean and unobstructed;
(h) Keep all plumbing fixtures in clean and provide and use a plunger for clearing toilet drains; Tenant agrees that should Landlord have to clear a toilet drain the Premises charge will be $55.00 during office hours and
(i) Provide and install shower curtains and bath mats for all tubs and showers to prevent water damage. Any damages resulting from the improper installation or used by the Tenant as clean as their condition permitsuse of mats and shower curtains will be charged to Tenant;
D. (j) Use in a reasonable manner all electrical, plumbing, sanitary, heating, ventilating, air conditioning and operate all electrical other facilities and plumbing fixtures properlyappliances. Tenant shall be responsible for notifying Landlord of any maintenance concerns in a timely manner. Failure to do so could result in Tenant being responsible for any additional utility costs and/or damages resulting from the unreported problem;
E. Comply with (k) Promptly vacate Premises at the requirements on termination of the Tenants Rental Agreement, whether by all applicable state and local housing, health and safety codesexpiration of the rental term or resulting from default of Tenant;
F. Personally refrain, and forbid any other person who is on the Premises with the Tenant’s permission, from intentionally or negligently destroying, defacing, damaging, or removing any fixture, appliance or, other part of the Premises;
G. Maintain in good working order and condition any range, refrigerator, washer, dryer, dishwasher, or other appliances supplied by the Landlord;
H. Promptly notify the Landlord of the need for repairs;
I. (l) Conduct the Tenant’s self and require other persons on the Premises with the Tenant’s consent to conduct themselves oneself in a manner that will not disturb Tenant's neighbors’ peaceful enjoyment, and require any person on Premises to conduct himself in a manner that will not disturb Tenant's neighbors’ peaceful enjoyment;
(m) Be responsible for the actions and damages caused by any invited or uninvited guests who may enter Landlord’s property as a result of Tenant’s neighbors’ “peaceful enjoyment” of hosting a party or gathering at the Premises;
J. Not unreasonably withhold consent for (n) Abide by all reasonable rules and regulations issued by Landlord and ensure that Tenant's guests and Occupants also abide by said Rules and Regulations and the Landlord or the Landlord’s agents provisions of paragraph 12 above;
(o) Replace all reasonably accessible burned out light bulbs, including exterior light fixtures adjacent to enter the Premises;
K. Conduct the (p) Keep thermostat set above 55 degrees to prevent freezing of pipes. Tenant agrees to allow Landlord to turn heat up to 55 degrees if pipes are in danger of freezing. Tenant will pay to repair all pipes that burst due to Tenant’s selfnegligence, and require persons in any resulting damages;

The Tenant shall regularly test all smoke detectors(r) Provide Landlord with keys and/or instructions on how to operate any new burglary prevention or fire detection devices that have been installed by Tenant. Upon termination of tenancy, supply electric current thereto (battery or electric current if required by lease)Landlord, Tenant shall remove all such devices and repair all damages;
(s) Remove snow and/or ice, as needed, in order to move vehicle from parking space. Tenant shall also be responsible for snow and/or ice removal from pathways, sidewalks, and driveways unless Premises is located in an apartment or condominium complex where these services may be provided by Landlord;
(t) Sweep, dust, and appropriately protect and maintain any hardwood floors throughout the term of this Rental Agreement to protect them against scratches; and
(u) Keep the Premises free from insects and pests, as those are defined in Virginia Code §3.2-3900, and promptly notify the Landlord of the existence of any mechanical failureinsects or pests.

(w) Secure at all times any firearm(s) in the Premises with either a trigger lock or similar device or store the Tenant’s consent to conduct themselves, firearm(s) in connection with the Premises so as not to violate the prohibitions contained in Chapters 2925, and 3719, of the Revised Code, or in municipal ordinances that are substantially similar to any section in either of those chapters, which relate to controlled substances;

C. Keep 's request. Where there is heating and air conditioning system separately servicing the Premises, Tenant at all plumbing fixtures times shall maintain the system in operating condition at Tenant's expense. Wherever heat generating machines or equipment are used in the Premises which may affect the temperature of any other tenant's Premises, Landlord reserves the right (i) to require Tenant to install supplementary air conditioning units in the Premises, or used by the (ii) to require Tenant to take other measures such as clean as their condition permits;
D. Use and operate all electrical and plumbing fixtures properly;
E. Comply with the requirements on the Tenants by all applicable state and local housing, health and safety codes;
F. Personally refraininsulation or relocation of equipment to alleviate any adverse effect upon such other tenant, and forbid any other person who is on in either case the Premises cost thereof, including the cost of installation and the cost of operation and maintenance, shall be paid by Tenant. Tenant shall contract with a licensed HVAC contractor to service the Tenant’s permission, from intentionally or negligently destroying, defacing, damagingunit, or removing any fixture, appliance or, other part units on a minimum basis of three times per year with a copy of the Premises;
G. Maintain service contract to be furbished to the Lessor within ten ( 10 ) days after opening for business, and a copy on any subsequent contracts to be furnished from time to time during the term. Said service contract shall provide that the HVAC contractor shall notify owner in good working order and condition writing if lessee terminates said contract. Lessor shall transfer any range, refrigerator, washer, dryer, dishwasher, or other appliances supplied by the Landlord;
