Common use of Tenant’s Space Plans Clause in Contracts

Tenant’s Space Plans. Landlord and Tenant acknowledge and agree that the plan prepared by the TI Architect attached hereto as Annex 1 (the “Space Plans”) and the TI specifications attached hereto as Annex 2 (the “TI Specs”) have been approved by both Landlord and Tenant. Landlord and Tenant further acknowledge and agree that any changes to the Space Plans or the TI Specs requested by Tenant constitute a Change Request the cost of which changes shall be paid for by Tenant. Tenant shall be solely responsible for all costs incurred by Landlord to alter the Building (or Landlord’s plans for the Building) as a result of Tenant’s requested changes.

Landlord and Tenant acknowledge and agree that the plan prepared by the TI Architect attached hereto as Annex Schedule 1 (the “Space PlansPlan”) and the TI specifications Landlord/Tenant Scope Allocation Matrix attached hereto as Annex Schedule 2 (the “TI SpecsAllocation Matrix”) have been approved by both Landlord and Tenant. Landlord and Tenant further acknowledge and agree that any changes to the Space Plans or the TI Specs Plan and Allocation Matrix requested by Tenant constitute a Change Request the cost of which changes shall be paid for by Tenantout of the TI Fund. Tenant shall be solely responsible for all costs incurred by Landlord to alter the Building (or Landlord’s plans for the Building) as a result of Tenant’s requested changes.
