Tenant's Waiver of Subrogation. Notwithstanding any other provision of this Lease, Tenant hereby waives any and all claims for loss or damage to Tenant's Improvements, furniture, furnishings, special equipment, and all other items of personal property located in the Building, caused by Library or its employees, officers, agents or licensees arising out of or resulting from any event or risk insured against under the fire and extended coverage insurance policy or policies required by Section 22(e), regardless of whether Tenant has maintained such policy or policies in full force and effect. Tenant shall obtain any endorsement which may be required by the fire and extended coverage insurance policy or policies carried by Tenant to reflect the foregoing waiver of subrogation and deliver evidence thereof to Library promptly after the execution of this Lease.

Tenant's Waiver of Subrogation. Tenant waives its claims as to and releases Landlord, its agents, officers and employees, for any loss or damage that may occur which is covered by the insurance described herein, including extended coverages and endorsements, and further agrees to notify its insurance carriers of this waiver so as to cause the respective policies of insurance to be properly endorsed, if necessary, to prevent invalidation of the insurance coverage by reason of this waiver of subrogation. Upon execution of this lease agreement and at any time upon reasonable request hereafter, Tenant shall provide Landlord with a certificate evidencing the foregoing insurance coverage.
Tenant's Waiver of Subrogation. Tenant shall relieve Landlord of all liability for loss or damage to Tenant’s property, including loss of use and/or any deductibles thereof, whether real or personal, and whether due to any act of commission or omission of Landlord, caused by fire and/or the other perils covered by the insurance Tenant is required to obtain in accordance with the terms of this Lease. Tenant’s property coverage will be endorsed to allow for Tenant’s waiver of subrogation as noted herein if the policy does not automatically allow Tenant to waive subrogation.
Tenant's Waiver of Subrogation. Tenant shall procure an appropriate clause in, or endorsement to, each of its policies for fire and extended coverage insurance, pursuant to which the insurance company waives subrogation or consents to waiver of its right of recovery against Landlord. Tenant shall not make any claim against or seek to recover from the Landlord for any loss or damage to its property or the property of others covered by such fire or extended coverage insurance.

  • Waiver of Subrogation Until this Indenture is discharged and all of the Notes are discharged and paid in full, each Guarantor hereby irrevocably waives and agrees not to exercise any claim or other rights which it may now or hereafter acquire against the Company that arise from the existence, payment, performance or enforcement of the Company’s obligations under the Notes or this Indenture and such Guarantor’s obligations under this Guarantee and this Indenture, in any such instance including, without limitation, any right of subrogation, reimbursement, exoneration, contribution, indemnification, and any right to participate in any claim or remedy of the Holders against the Company, whether or not such claim, remedy or right arises in equity, or under contract, statute or common law, including, without limitation, the right to take or receive from the Company, directly or indirectly, in cash or other property or by set-off or in any other manner, payment or security on account of such claim or other rights. If any amount shall be paid to any Guarantor in violation of the preceding sentence and any amounts owing to the Trustee or the Holders of Notes under the Notes, this Indenture, or any other document or instrument delivered under or in connection with such agreements or instruments, shall not have been paid in full, such amount shall have been deemed to have been paid to such Guarantor for the benefit of, and held in trust for the benefit of, the Trustee or the Holders and shall forthwith be paid to the Trustee for the benefit of itself or such Holders to be credited and applied to the obligations in favor of the Trustee or the Holders, as the case may be, whether matured or unmatured, in accordance with the terms of this Indenture. Each Guarantor acknowledges that it will receive direct and indirect benefits from the financing arrangements contemplated by this Indenture and that the waiver set forth in this Section 11.05 is knowingly made in contemplation of such benefits.

  • Waivers of Subrogation To the fullest extent permitted by law, the Contractor hereby waives its rights and its insurer(s)’ rights of recovery against County under all the Required Insurance for any loss arising from or relating to this Contract. The Contractor shall require its insurers to execute any waiver of subrogation endorsements which may be necessary to effect such waiver.
