Termination Expenses. 8.3.1. Termination Expenses are in addition to Compensation for Basic and Additional Services and are full compensation for all damages and expenses that are directly or indirectly attributable to termination. Termination Expenses are applicable only to a termination for convenience by the School District and shall be computed as a percentage of the total compensation for the terminated Basic Services earned to the time of termination, as follows: .1 Five percent (5%) of the total remaining compensation for the terminated Basic Services earned to date of termination if termination occurs before or during the pre-design or Design Phases; or .2 Two percent (2%) of the total remaining compensation for the terminated Basic Services earned to date of termination if termination occurs during any subsequent phase.
