Common use of Termination for Disability/Death Clause in Contracts

Termination for Disability/Death. If Assistant Coach dies or becomes permanently disabled to the extent that, in the judgment of the Athletics Director, Assistant Coach cannot satisfactorily perform the duties of Assistant [Men’s/Women’s] [delete if sport is football] __________ Coach (“Inability to Perform”), this Agreement shall terminate and all obligations of the University to compensate Assistant Coach pursuant to this Agreement shall cease as of the date of such death or disability. The University shall be obligated to compensate Assistant Coach or Assistant Coach’s estate in accordance with this Agreement for services performed prior to the termination date and Assistant Coach or Assistant Coach’s estate shall be entitled to those benefits, if any, that are payable under any University sponsored group employee insurance or benefit plan in which Assistant Coach is or was enrolled.
