Termination for Non-Allocation of Funds. If funds are not allocated to continue this Agreement in any future period, the Counties may terminate this Agreement under Section 21.3 (Termination for Convenience). The Counties will not be obligated to pay any further Charges for Services or Charges for such future period, but the Counties shall make payments for Services, Deliverables and Contractor’s costs as provided in Section 21.3.3, subject to the Counties’ availability of funding therefor. The Counties agree to notify Contractor of such non-allocation at the earliest reasonable time. No penalty shall accrue to the Counties in the event this Section shall be exercised.
