Common use of Termination of Employment Relationship Clause in Contracts

Termination of Employment Relationship. Apache and Employee have agreed to the following terms and conditions concerning Employee’s resignation from Apache. Employee’s last day of work for Apache was October 9, 2014 (“Resignation Date”). Apache and Employee both agree that Employee will “separate from service” (for purposes of section 409A of the Internal Revenue Code of 1986, as amended (the “Code”)) on October 9, 2014.

Apache Such amounts shall be subject to all lawful deductions and Employee both agree that Employee will “separate from service” (withholding for purposes of section 409A of the Internal Revenue taxes and any delay in payment required by Tax Code of 1986, as amended (the “Code”)) on October 9, 2014.409A.
