Termination of Lease for Substantial Taking. If all or Substantially All of the Premises are taken (excluding a taking of the fee interest in the Premises if, after such taking, Tenant’s rights under this Lease are not affected and no rights of the Recognized Mortgagee are affected) for any public or quasi-public purpose by any lawful power or authority by the exercise of the right of condemnation or eminent domain or by agreement among Owner, Tenant, Recognized Mortgagee and those authorized to exercise such right, this Lease shall terminate on the Date of Taking and the Rent and/or Impositions payable by Tenant hereunder shall be apportioned and paid to the Date of Taking.
