Common use of Termination of Service or Voluntary Resignation Clause in Contracts

Termination of Service or Voluntary Resignation. Should Executive voluntarily resign from his employment or should he/she be discharged for Due Cause (exclusive of Early Retirement, Severance, Change in Control, Death or Total and Permanent Disability), all Executive’s benefits under this Agreement shall be forfeited and this Agreement shall become null and void. If a dispute arises as to discharge “for Due Cause”, such dispute shall be resolved by arbitration as set forth in Article IV, B.
