Common use of Termination of Xxxxxxxxx Clause in Contracts

Termination of Xxxxxxxxx. In the event of a default under the Xxxxxxxxx that results in the termination of the Xxxxxxxxx, Subtenant shall, at the option of Overlandlord, attorn and recognize Overlandlord as Sublandlord hereunder pursuant to the then executory terms of this Sublease and shall, promptly upon Overlandlord’s request, execute and deliver all instruments necessary or appropriate to confirm such attornment and recognition; provided that Sublandlord’s default was not caused by a default by Subtenant under the Xxxxxxxxx.

Termination of Xxxxxxxxx. In the event of a default under the Xxxxxxxxx that results in the termination of the Xxxxxxxxx, Subtenant shall, at the option of Overlandlord, attorn and recognize Overlandlord as Sublandlord hereunder pursuant to the then executory terms of this Sublease and shall, promptly upon Overlandlord’s request, execute and deliver all instruments necessary or appropriate to confirm such attornment and recognition; provided that Sublandlord’s default was not directly caused by a default by Subtenant under the Xxxxxxxxx.

Termination of Xxxxxxxxx. In the event of a default under the Xxxxxxxxx by Sublandlord that results in the termination of the Xxxxxxxxx, Subtenant shall, at the option of Overlandlord, provided in writing to Subtenant (to the extent required by the Xxxxxxxxx), attorn to and recognize Overlandlord as Sublandlord hereunder pursuant to the then executory terms of this Sublease and shall, promptly upon Overlandlord’s written request, execute and deliver all instruments necessary or appropriate to confirm such attornment and recognition; provided that Sublandlord’s default was not caused by a default by Subtenant under the Xxxxxxxxx.
