Common use of Termination on Account of Death Clause in Contracts

Termination on Account of Death. In the event of Executive's death while in the employ of the Company, his employment hereunder shall terminate on the date of his death and Executive shall be paid his unpaid Base Salary through the date of termination and the amount of any unpaid Bonus to which Executive had become entitled under the Bonus Plan prior to the effective date of such termination. In addition, any other benefits payable on behalf of Executive shall be determined under the Company's insurance and other compensation and benefit plans and programs then in effect in accordance with the terms of such programs.

Termination on Account of Death. In the event of Executive's death while in the employ of the Company, his employment hereunder shall terminate on the date of his death and Executive shall be paid (x) his unpaid Base Salary through the date of termination and the amount of (y) any unpaid Bonus to which Executive had become entitled under Compensation for the Bonus Plan prior to the effective date of such terminationyear. In If the event of Executive's death while employment shall be terminated by reason of his death, the Company shall pay to such person as the Executive shall have designated in the employ of a notice filed with the Company, or if no such person shall have been designated, to his employment hereunder shall terminate on estate, an amount equal to his unpaid but accrued and fully earned salary to the date of his death and Executive shall be paid his unpaid Base Salary through the date of termination and the amount of any unpaid Bonus to which Executive had become entitled under the Bonus Plan prior to the effective date of such termination. In addition, any other benefits payable on behalf of Executive shall be determined under the Company's insurance and other compensation and benefit plans and programs then in effect in accordance with the terms of such programsdeath.
