Common use of TERMINATION OR MODIFICATION OF AGREEMENT Clause in Contracts

TERMINATION OR MODIFICATION OF AGREEMENT. The City may terminate or modify this Agreement, or those transferred or assigned rights and obligations, as the case may be, relating solely to the defaulting Developer or Transferee and such defaulting party’s portion of the Property after such final determination of the City Council or, where no appeal is taken after the expiration of the appeal periods described in Section 7.3 relating to the defaulting party’s rights and obligations. There shall be no termination or modification of this Agreement unless the City Council acts pursuant to Section 7.3.

TERMINATION OR MODIFICATION OF AGREEMENT. The City may terminate or modify this Agreement, or those transferred or assigned rights and obligations, as the case may be, relating solely to the defaulting Developer after a finding or Transferee and such defaulting party’s portion of the Property after such final determination of noncompliance by the City Council or, where no appeal is taken taken, after the expiration of the appeal periods described in Section 7.3 relating to the defaulting party’s rights and obligations6.3. There shall be no termination or modification modifications of this Agreement unless the City Council acts pursuant to Government Code Sections 65867.5 and 65868, irrespective of whether an appeal is taken as provided in Section 7.3.6.3.‌

There shall be no termination or modification of this Agreement unless the City Council acts pursuant to Section 7.36.3 hereof.
