Common use of The Agents in their Individual Capacities Clause in Contracts

The Agents in their Individual Capacities. Each of the Agents and their affiliates may make loans to, accept deposits from and generally engage in any kind of business with the Company as though such Agent were not an Agent hereunder. With respect to its Loans made or renewed by it, any Note issued to it and any Letter of Credit issued by it, each Agent shall have the same rights and powers under this Agreement as any Bank or Issuing Bank, as applicable and may exercise the same as though it were not an Agent, and the terms “Bank” and “Banks” shall include each Agent in its individual capacity.

With respect to its the Loans made or renewed by it, any Note issued to it and any Letter of Credit issued by all Obligations owing to it, each Agent shall have the same rights and powers under this Agreement as any Bank or Issuing Bank, as applicable and may exercise the same as though it were not an Agent, and the terms “"Bank” " and “"Banks” " shall include each Agent in its individual capacity.
