The Build- Operate-Transfer Agreement Sample Clauses

The Build-Operate-Transfer (BOT) Agreement is a contractual arrangement where a private entity is granted the right to finance, construct, and operate a project—such as infrastructure or utilities—for a specified period before transferring ownership to a public authority. During the operational phase, the private party typically recoups its investment and earns profits by charging users or receiving payments from the government. This clause is commonly used in large-scale projects like highways, power plants, or water treatment facilities. Its core function is to facilitate private sector participation in public infrastructure development while ultimately ensuring public ownership and control after the transfer.
