The City' s Liability. Anything contained in this Agreement to the contrary notwithstanding, Concessionaire agrees that Concessionaire shall look solely to the estate and property of the City for the collection of any judgment or other judicial process requiring the payment of money by the City for any default or breach by the City under this Agreement. No officers, agents and employees shall be subject to levy, execution or other judicial process for the satisfaction of Concessionaire's claim. Notwithstanding the foregoing, nothing in this Agreement shall be construed as waiving the City's immunity from suit or liability pursuant to the doctrine of sovereign immunity.

  • Liability of City CITY’S PAYMENT OBLIGATIONS UNDER THIS AGREEMENT SHALL BE LIMITED TO THE PAYMENT OF THE COMPENSATION PROVIDED FOR IN SECTION 3.3.1, “PAYMENT,” OF THIS AGREEMENT.   • Damage Liability The University is not liable for damage to or loss of personal property, failure or interruption of utilities, or for injury or inconvenience to persons (except to the extent set forth in Florida Statutes, Sec. 768.28) Students are encouraged to provide their own personal property loss insurance.
