Common use of The Guarantees Clause in Contracts

The Guarantees. Subject to the provisions of this Article 11, each Guarantor hereby irrevocably and unconditionally guarantees, jointly and severally, the full and punctual payment (whether at Stated Maturity, upon redemption, purchase pursuant to an Offer to Purchase or acceleration, or otherwise) of the principal of, premium, if any, and interest (including Post Petition Interest) on, and all other amounts payable under, each Note, and the full and punctual payment of all other amounts payable by the Company under this Indenture. Upon failure by the Company to pay punctually any such amount, each Guarantor shall forthwith on demand pay the amount not so paid at the place and in the manner specified in this Indenture.

The Guarantees. Subject to the provisions of this Article 1110, each Guarantor of the Guarantors hereby irrevocably and unconditionally guaranteesirrevocably, jointly and severally, fully and unconditionally guarantees on an unsecured and unsubordinated basis, the full and punctual payment (whether at Stated Maturitystated maturity, upon redemption, purchase pursuant to an Offer offer to Purchase purchase or acceleration, or otherwise) of the principal Principal of, premium, if any, and interest (including Post Petition Interest) on, and all other amounts payable under, each NoteSecurity of any series, and the full and punctual payment of all other amounts payable by the Company under this Indenture. Upon failure by the Company to pay punctually any such amount, each Guarantor shall forthwith on demand pay the amount not so paid at the place and in the manner specified in this Indenture.

The Guarantees. Subject to the provisions of this Article 11Article, each Guarantor hereby irrevocably and unconditionally guarantees, jointly and severally, on a senior basis, the full and punctual payment (whether at Stated Maturity, upon redemption, purchase pursuant to an Offer to Purchase or acceleration, or otherwise) of the principal of, premium, if any, and interest (including Post Petition Interest) on, and all other amounts payable under, each Note, and the full and punctual payment of all other amounts payable by the Company under this the Indenture. Upon failure by the Company to pay punctually any such amount, each Guarantor shall forthwith on demand pay the amount not so paid at the place and in the manner specified in this the Indenture.

The Guarantees. Subject to the provisions of this Article 1113, each Guarantor hereby irrevocably and unconditionally guarantees, jointly and severally, the full and punctual payment (whether at Stated Maturity, upon acceleration, optional redemption, purchase pursuant to an upon repurchase following a Offer to Purchase or acceleration, or otherwise) of the principal of, of and premium, if any, and interest (including Post Petition Interest) on, and all other amounts payable under, each NoteNote provided for under this Indenture, and the full and punctual payment of all other amounts payable by the Company under this Indenture. Upon failure by the Company to pay punctually any such amount, each Guarantor shall forthwith on demand pay the amount not so paid at the place and in the manner specified in this Indenture, subject to the terms of the Intercreditor Agreement.

The Guarantees. The Guarantees. The Guarantees. Subject to the provisions of this Article 118, each Guarantor hereby irrevocably and unconditionally guarantees, jointly and severally, on a secured basis, the full and punctual payment (whether at Stated Maturitythe Maturity Date, upon redemption, purchase pursuant to an Offer to Purchase Article 5 or Article 6 or acceleration, or otherwise) of the principal of, premium, if any, and interest (including Post Petition Interest) on, and all other amounts payable under, each NoteSecurity, and the full and punctual payment of all other amounts payable by the Company under this IndentureIndenture and each other Note Document. Upon failure by the Company to pay punctually any such amount, each Guarantor shall forthwith on demand pay the amount not so paid at the place and in the manner specified in this Indenture.

The Guarantees.
