Common use of The Retailer Clause in Contracts

The Retailer. The Retailer: (a) will not knowingly do or omit to do anything, or cause any person to do or omit to do anything, that is inconsistent with the obligations of the Consumer or the Distributor under any Distributor’s Agreement. However, the technical requirements in a Distributor’s Agreement may differ from the technical requirements in relation to Distribution Services set out in this agreement, if the Distributor has given the Retailer reasonable notice of those requirements; and (b) acknowledges that the Distributor will be entitled to terminate any Distributor’s Agreement in accordance with its terms.
