The SELLER acknowledges Sample Clauses

The SELLER acknowledges. 11.2.1 Should the PURCHASER fail to pay the AUCTIONEER's fee and notwithstanding the PURCHASER'S failure, the SELLER elects to proceed with the sale then the SELLER shall pay the AUCTIONEER’s fee, which fee shall be deemed to have been earned upon the signature by or on behalf of the SELLER and the PURCHASER to the Agreement and shall be payable by way of deduction from the purchase price. In addition, the SELLER shall be liable to pay the AUCTIONEER's fee in any one or more of the under mentioned circumstances:
