Common use of THE TOWN’S WORK Clause in Contracts

THE TOWN’S WORK. The Owner shall: (a) perform or cause to be performed the Town’s Work required as set out in Schedule “K” and the tender documents whether within or outside of the plan for all park improvement, engineering work and electrical work identified as being done by the Owner on behalf of the Town in accordance with Schedule “K” and the tender documents and at a cost to the Town which does not exceed the identified cost of works identified in Schedule “K”; (b) do and fulfill or cause to be done and fulfilled everything indicated by this Agreement; and (c) commence or cause the commencement of the Town’s Work by the date identified in Schedule “K” and subject to reasonable extensions resulting from Changes in the Work and to events of force majeure attain Substantial Performance of the Town’s Work, as certified by a Qualified Landscape Architect, or Qualified Professional Engineer or Qualified Electrical Engineer, as may be appropriate, by the date identified in Schedule “K”.
