Common use of THEATRICAL Clause in Contracts

THEATRICAL. 1. This Basic Agreement shall be binding upon the Company and its subsidiaries in which it has a fifty percent (50%) or more financial interest and all parties who by reason of mergers, consolidations, reorganizations, sale, assignment or the like shall succeed to or become entitled to a substantial part of the business of a signatory. 2. With respect to a motion picture produced by an independent producer under a contract with the Company for the financing and distribution of such motion picture, if Company gives the Guild notice within ten (10) days following agreement between Company and independent producer with respect to such contract that such motion picture is not covered by this Basic Agreement, then Company shall not be obligated with respect to such picture except as otherwise provided in Article 15. If the Company does not give the Guild such notice, then Company shall be obligated under this Basic Agreement (and no other collective bargaining agreement with the Guild shall be applicable) with respect to such motion picture. The provisions of this subparagraph 2. apply only to: a. a writer whose employment, had he/she been employed directly by Company in connection with such motion picture, would have been covered by this Basic Agreement; and
