Third Party Activity. During the term of this Agreement, other Persons may develop, construct or acquire, and operate generating facilities in EPE’s service territory, and reservations of transmission service by such Persons under the EPE OATT may adversely affect the availability of transmission service for the Facility’s electric output. EPE has no obligation to disclose to Generator any information regarding such third party activity, except as may be required under the EPE OATT or under this Agreement subject to the provisions of Article 3.
Third Party Activity. The Licensee is responsible to AppyHive for their third- party users’ activities under their account (e.g. adding them to your provided Applications to manage their activities and data) and their compliance under the terms of this License. Any actions undertaken by the Licensee’s third-party users arising out of this License shall be deemed to have been taken by the Licensee, and the Licensee (in addition to their third-party users) shall be responsible to AppyHive for all such actions.

The Utilities have no obligation to disclose to Generator any information regarding such third party activity, except as may be required under the Utilities’ OXXXx or under this Agreement subject to the provisions of Article 3.
