Common use of Third Party Code Clause in Contracts

Third Party Code. The Application may contain or be provided with components subject to the terms and conditions of “open source” software licenses (“Open Source Software”). Open Source Software may be identified in the Documentation, or Cloud Cruiser and/or Tableau shall provide a list of the Open Source Software for a particular version of the Application to End User upon End User’s written request. To the extent required by the license that accompanies the Open Source Software, the terms of such license will apply in lieu of the terms of this Agreement with respect to such Open Source Software, including, without limitation, any provisions governing access to source code, modification or reverse engineering.

The Application Software may contain or be provided with components that are licensed from third parties, including components subject to the terms and conditions of “open source” software licenses (“Open Source Software”). Open Source Software may be identified in the Documentation, or Cloud Cruiser and/or Tableau shall provide in a list of the Open Source Software for a particular version of the Application provided to End User Licensee upon End UserLicensee’s written request. To the extent required by the license that accompanies the Open Source Software, the terms of such license will apply and prevail in lieu case of conflict with the terms of this Agreement with respect to such Open Source Software, including, including without limitation, any provisions governing access to source code, modification or reverse engineering.

To the extent required by the license that accompanies the Open Source Software, the terms of such license will apply in lieu of the terms of this Agreement with respect to such Open Source Software, including, without limitation, any provisions governing access to source code, enhancement, modification or reverse engineering.
