Third Party Contract Rights. The Parties acknowledge and agree for the purposes of the Contracts (Rights of Third Parties) Xxx 0000 that no rights, powers or benefits are or shall be conferred on any person pursuant to this Agreement save that: 19.3.1. the System Operator shall be entitled to enforce the provisions of clause 16.6 (Confidentiality) and clause 20.1 (EMR) of this Agreement; and 19.3.2. SPN shall be entitled to enforce any of the provisions of this Agreement to the extent that they affect its rights as owner of the SPN Network, including the provisions of clause 12 (Liability).
