Common use of Third Party Funding Clause in Contracts

Third Party Funding. (a) The Subrecipient shall take, in a timely fashion, all actions required or necessary to enable it to obtain the full anticipated proceeds of any Third-Party Funding. (b) The Subrecipient shall comply with all stated conditions to any Third-Party Funding commitment, as the same may be amended and supplemented, and all applicable present and future eligibility requirements of such Third-Party Funding commitment. (c) The Subrecipient shall promptly, and in any event within five (5) days after having notice or knowledge thereof, inform the County in writing of any anticipated failure on its part to (i) meet all eligibility requirements of any Third- Party Funding, (ii) be qualified to receive any Third-Party Funding proceeds in an amount at least equal to such Third-Party Funding commitment, or (iii) receive the proceeds of such Third-Party Funding.
