Common use of Third Party Providers Clause in Contracts

Third Party Providers. If Provider receives written notice from any third party service provider that such Person intends to terminate a service pursuant to which Provider provides a Service to Recipient, then Provider shall provide a copy of such written notice to Recipient and shall use commercially reasonable efforts to secure the continued provision of that service from such third party or an alternative service provider. If Provider is unable to secure the continued provision of that service from such third party or an alternative service provider, Provider shall not be required to provide the affected Service.

Third Party Providers. If Service Provider receives written notice from any third party service provider that such Person intends to terminate a service pursuant to which the Service Provider provides a Service to the Service Recipient, then the Service Provider shall provide a copy of such written notice to the Service Recipient and shall use commercially reasonable efforts to secure the continued provision of that service Service from such third party or an alternative service provider, the reasonable costs of which shall be deemed to be Service Costs. If the Service Provider is unable to secure the continued provision of that service Service from such third party or an alternative service provider, Service Provider shall not be required to provide the affected Service.
