Common use of Three-Arbitrator Panel Clause in Contracts

Three-Arbitrator Panel. Should the Parties fail to agree on a single arbitrator within that 20-Day period, each Party may appoint one arbitrator within 14 Days thereafter pursuant to the Arbitration Rules. If any Party does not appoint an arbitrator within that 14-Day period, Dispute Prevention & Resolution, Inc. shall appoint one or both of the arbitrator(s), as appropriate. Within 20 Days of the appointment of the second arbitrator, the two appointed arbitrators shall attempt to agree upon the appointment of a third arbitrator. If the two appointed arbitrators fail to agree upon the appointment of the third arbitrator within this 20-Day period, Dispute Prevention & Resolution, Inc. shall appoint the third arbitrator.
