Common use of Time Restriction Clause in Contracts

Time Restriction. If the grievance is not filed or advanced in accordance with the time limits set forth within the procedure, the grievance shall be considered non-submitted or resolved on the basis of the Employer's last response. A grievance not responded to by the Employer within the prescribed time limits shall be granted, provided that the remedy sought conforms to the provisions of this agreement and applicable laws. The parties may mutually agree to extend the time limits for any step of this procedure and any extension shall be reduced to writing for a specified period of time. All references to “working days” in this Article shall exclude Saturdays, Sundays, and all holidays recognized in Article 13 of this Agreement.
