Timely Decisions. The Owner represents that it will assure reasonable access to available necessary records, reasonable cooperation on the part of affected officials and employees, and expeditious decisions on matters that affect the progress of work under this Contract.
Timely Decisions. Any dispute referred to arbitration will be dealt with on an expeditious basis with both parties using all commercially reasonably efforts to obtain and implement a timely decision of the arbitrator who will have the authority to award treble costs of the arbitration proceedings against any party which does not, in the judgment of the arbitrator, act in accordance with this Section.

Timely Decisions. District shall make all decisions required of District including Trade Contract awards in accordance with the Project Schedule but also in light of the schedule of the Governing Board.

Give timely consideration to all requests from the Consultant, including requests for decisions required relating to the Services, and inform the Consultant of the Client’s decisions and provide all feedback in a timely manner so as not to unduly delay the Consultant’s performance of the Services. Access to Property – Arrange and make provision for the Consultant’s reasonable and ready access to public and private properties as necessary for the Consultant to perform the Services.
Timely Decisions. Owner shall render decisions in a timely manner and in accordance with the Owner-approved Project Schedule. Owner shall furnish to Construction Manager, within fifteen (15) days after receipt of a written request, information necessary and relevant for Construction Manager to evaluate, give notice of or enforce mechanic’s lien rights. Such information shall include a correct statement of the record legal title to the Property. In addition, Owner shall provide responses to all Requests for information (RFI’s) within seven (7) days. The Construction Manager shall provide a submittal schedule of anticipated submission dates, updated monthly, which will be used to agree upon the response time for each submittal. The target shall be to return submittals within fourteen (14) days; however the final determination of the response time will be based upon the workload dictated by the submittal schedule and shall be contingent on the Construction Manager making its submissions in accordance with the submittal schedule.
Timely Decisions. The Development Manager shall not be responsible for any delay, loss or damage caused by the Owner’s failure or refusal to provide timely decisions, information or funds required by the Owner provided the Development Manager has provided the Owner a reasonable opportunity to review and consider each such matter; and
