T&M Costs. (a) T&M Services are not included in the Fixed Fee. Provided that the T&M Services are authorized by Owner or the express terms of this Agreement and rendered by O&M Contractor, such T&M Services shall be billed to Owner at the T&M Costs and shall be considered “Services” for the purpose of this Agreement.
