Toll Revenue Risk. Except as otherwise provided herein, the Developer understands and agrees that all toll revenue, including all revenue risk associated with the volume of HOV use, remains with the Developer, and the Department will have no financial responsibility whatsoever for such HOV volume, including HOV use that is greater than projected in the Base Case Financial Model.
