Tolling of Restrictive Period. The time period during which Employee is to refrain from the activities described in Section 7 of this Agreement will be extended by any length of time during which Employee is in breach of Section 7 of this Agreement. The Employee acknowledges that the purposes and intended effects of the restrictive covenants would be frustrated by measuring the period of the restriction from the date of termination of Employee’s employment where the Employee failed to honor the restrictive covenant until required to do so by court order.
