Total Student Enrollment. As set forth above, the School is authorized to enroll the following: [Insert student enrollment numbers here.] The School shall provide instruction to students in such grades and subject to approved caps in each year of operationxxix. The School may make modifications as to the number of students in any particular grade, and number of students within a class to accommodate staffing decisions that are consistent with the School’s programmatic needs, and attrition patterns. However, the School shall not increase the number of grades or the total number of students proposed to be served in each grade without an amendment to this contract or waiver of grade cap provisionxxx. If the School seeks to amend enrollment or grades served, the School must, among other things, demonstrate that such changes in enrollment/grades served do not adversely compromise the fiscal and educational program of the School.
