Common use of Trade Secret and Proprietary Information Clause in Contracts

Trade Secret and Proprietary Information. Executive acknowledges and agrees to those certain covenants set forth in the Trade Secret and Proprietary Information Agreement (the “TSPI Agreement”) set forth as Exhibit A hereto. The covenants in the TSPI Agreement do not supersede or replace any other confidentiality, non-competition or non-solicitation agreement entered into between the Executive and the Company to the extent that such confidentiality, non-competition and/or non-solicitation agreement is more protective of the business of the Company.

Trade Secret and Proprietary Information. Executive Employee acknowledges and agrees to those certain covenants set forth in the Trade Secret and Proprietary Information Agreement (the “TSPI Agreement”) set forth as Exhibit Annex A hereto. The covenants provisions in the TSPI Agreement do not supersede or replace any other confidentiality, non-competition or competition, non-solicitation or similar provisions in any agreement entered into between the Executive Employee and the Company or any affiliate thereof, to the extent that such confidentiality, non-competition and/or competition, non-solicitation agreement is or similar provisions are more protective of to the business of the CompanyCompany or any affiliate thereof.
