Training Capacity Clause Samples

The Training Capacity clause defines the maximum number of individuals or sessions that can participate in or benefit from a training program under the agreement. It typically specifies limits such as the number of trainees per session, the total number of sessions, or the overall participant cap during the contract term. This clause ensures that both parties have a clear understanding of the scale of training to be provided, preventing misunderstandings about resource allocation and helping manage expectations regarding the scope of services.
Training Capacity. If student(s) is participating in clinical training, student(s) shall perform in a training capacity only and shall not be used to treat patients in lieu of trained professionals employed by FACILITY. Student(s) shall perform services for patients only when under the supervision of a qualified FACILITY professional. FACILITY and SCHOOL shall coordinate all appropriate supervision.

Training Capacity. Employees in a training capacity may be assigned work normally 17 performed by a higher classification, except they will not be placed in a training capacity to 18 circumvent the intent of CLA Article 33 Working Out of Class. An employee assigned to a training 19 capacity shall be under the supervision and guidance of their immediate supervisor and shall not be 20 in the training position for more than ten (10) consecutive, regular working days. It is understood that 21 employees performing work pursuant to this Section are not performing a Working Out of Class 22 assignment.
