Common use of Transactions Part of Agreement Clause in Contracts

Transactions Part of Agreement. Upon the receipt by Seller of an executed Confirmation from Buyer within the applicable time period described in Section 2.1, a Transaction shall exist between the parties on the terms set forth therein. Such Transaction shall constitute an integral part of this Agreement, and shall be read and construed as one with this Agreement. All Transactions which are in effect or remain to be performed at any time shall collectively be deemed to be a part of this Agreement and shall be referred to collectively as "this Agreement." Any discrepancy between the terms of this Agreement and the terms of a Confirmation shall be resolved in favor of the terms of the Confirmation.
