Common use of Transboundary Spills Clause in Contracts

Transboundary Spills. An exception to this Agreement may occur in cases where a spill in one jurisdiction is likely to impact waters of an adjacent jurisdiction. In such cases the Unified Command requesting mutual aid will collaborate with their counterparts on system deployment and may not invoke this agreement with the adjacent jurisdiction. The Members will assure a coordinated response action using all necessary resources.
