Road Surfaces. (1) Grade, shape, crown, and/or outslope surface and shoulders. (2) Provide leveling, patching, and/or reinforcement rock for restoring purposes. (3) Prevent contamination of road surface materials with soil and vegetative material. (4) Prevent road surface materials from being bladed off the road. Temporarily cease road use to prevent and/or protect the road during adverse weather conditions. Examples of adverse weather conditions are freezing and thawing cycles, high soil moisture caused by rainfall events, and accumulation of snow that requires removal to continue hauling activity. PURCHASER shall be excluded from the normal road maintenance responsibility on the following roads: Those roads shown on Exhibit A as "Existing Roads – State Maintained." However, should it be necessary during the period of this contract for STATE to discontinue normal or extraordinary maintenance of such roads, then, upon notification from STATE, PURCHASER shall perform all such maintenance, and STATE shall modify the contract as specified in Section 27. The following road segments shall be closed prior to October 15, annually: At Points A, G, I, and N. These roads shall be closed by constructing a barrier which makes the road impassable to vehicular traffic. All road closures shall be approved by STATE. Closed roads shall be waterbarred when erosion potential exists, or where directed by STATE. PURCHASER shall construct waterbars as directed by STATE. The above listed road segments may be reopened after June 1 upon written approval by STATE. Log hauling shall not be allowed on dirt spurs from October 15 through June 1, unless otherwise approved in writing by STATE. Hauling from Point A to B will not be seasonally restricted if the road is rocked and additional drainage is added according to the specifications in Exhibit F. Extraordinary maintenance is defined as major repair work and/or damage caused by acts of God or causes beyond the control of the PURCHASER, as defined in Section 28. STATE may require PURCHASER to perform extraordinary maintenance. STATE shall describe the amount and specifications of work to be done in writing, and make adjustments in accordance with Section 28. PURCHASER may use 1,000 cubic yards of rock from the STATE stockpiles located in the NW ¼, Section 18, T7N, R6W (Knob Point) and the SE ¼, Section 17, T6N, R6W (Xxxxxxxx Quarry), X.X., Clatsop County, Oregon, for maintenance on STATE roads. Prior to any rock spreading, PURCHASER shall obtain approval from STATE. The following road segments shall be closed prior to October 1: 7A to 7B. Additional grading and dust abatement shall be required on the section of road from Hwy. 66 to the Topsy Campground. Log hauling shall not be allowed from October 1 through May 1, unless otherwise approved in writing by STATE.
