The Transfer/Advancement clause governs the conditions under which rights, obligations, or interests under an agreement may be transferred or advanced from one party to another. Transfer/Advancement. The District shall select an employee from those possessing the same classification and required qualifications to perform the work involved and who have made their desires known in accordance with paragraph 3 of this Article. When qualifications are met, seniority shall govern in such selections. In determining the qualifications of an employee for movement into a classification, the District shall consider the employee's skill to perform under the classification and the employee's demonstrated ability on the present job assignment. 4.1 In the event that no employee, in the same classification applies for the vacant position, the Employer may select another employee possessing the required qualifications to perform the work involved and who have made their desires known in accordance with paragraph 3 of this Article.
