Transfer of VA Equipment to Site. Except as set forth in subparagraph (iii), after the Nevymáhanie akejkoľvek podmienky tejto zmluvy nemá byť interpretované ako zrieknutie sa tejto podmienky. Ak sa ktorákoľvek časť tejto zmluvy ukáže ako nevymáhateľná, zostáva zvyšok tejto zmluvy platný a účinný. Táto zmluva je záväzná pre zmluvné strany a ich následníkov a nástupcov. Zdravotnícke zariadenie nesmie postúpiť ani presunúť žiadne zo svojich práv a povinností podľa tejto zmluvy bez písomného súhlasu zadávateľa. Zadávateľ ,alebo spoločnosť IQVIA na požiadanie zadávateľa, môže postúpiť túto zmluvu tretej osobe (a spoločnosť IQVIA môže na požiadanie zadávateľa postúpiť svoje práva a povinnosti podľa tejto zmluvy na zadávateľa) a zadávateľ alebo spoločnosť IQVIA (podľa toho, ktorý prípad nastane) nebude zodpovedať za žiadne povinnosti alebo záväzky podľa tejto zmluvy, ktoré vzniknú po dátume takéhoto postúpenia a zdravotnícke zariadenie s takýmto postúpením súhlasí. Nástupca bude zdravotnícke zariadenie o takomto postúpení urýchlene informovať. Platnosť podmienok tejto zmluvy, ktoré obsahujú povinnosti alebo práva presahujúce dobu dokončenia skúšania, xxxxx xxxx, ktoré sú obsiahnuté v článkoch č. 2, 3, 4, 6, 7 a 10 tejto Prílohy A, pretrvá aj po vypovedaní alebo splnení tejto zmluvy. Vybavenie Vybavenie na vyšetrenia zrakovej ostrosti Pod nižšie uvedenými podmienkami môže zadávateľ alebo IQVIA v odôvodnených prípadoch poskytnúť vybavenie na vyšetrenia zrakovej ostrosti (ďalej „vybavenie na VZO“), alebo iné menšie vybavenie (ďalej „menšie vybavenie“), požadované na použitie v skúšaní, ak pracovisko skúšania takéto vybavenie na VZO alebo menšie vybavenie inak nevlastní alebo k nemu nemá prístup, aby ho mohlo použiť v skúšaní. Počiatočná hodnota žiadneho vybavenia na VZO ani menšieho vybavenia nepresiahne 500 USD.

  • TRANSFER OF RIGHTS IN THE PROPERTY This Security Instrument secures to Lender (i) the repayment of the Loan, and all renewals, extensions, and modifications of the Note, and (ii) the performance of Borrower’s covenants and agreements under this Security Instrument and the Note.   • Transfer of Data The Participant consents to the Company or any Affiliate thereof processing data relating to the Participant for legal, personnel, administrative and management purposes and in particular to the processing of any sensitive personal data relating to the Participant. The Company may make such information available to any Affiliate thereof, those who provide products or services to the Company or any Affiliate thereof (such as advisers and payroll administrators), regulatory authorities, potential purchasers of the Company or the business in which the Participant works, and as may be required by law.

  • Transfer or Deletion of Student Data The Provider shall review, on an annual basis, whether the Student Data it has received pursuant to the DPA continues to be needed for the purpose(s) of the Service Agreement and this DPA. If any of the Student Data is no longer needed for purposes of the Service Agreement and this DPA, the Provider will provide written notice to the LEA as to what Student Data is no longer needed. The Provider will delete or transfer Student Data in readable form to the LEA, as directed by the LEA (which may be effectuated through Exhibit D of the DPA), within 30 calendar days if the LEA requests deletion or transfer of the Student Data and shall provide written confirmation to the LEA of such deletion or transfer. Upon termination of the Service Agreement between the Provider and LEA, Provider shall conduct a final review of Student Data within 60 calendar days. If the LEA receives a request from a parent, as that term is defined in 105 ILCS 10/2(g), that Student Data being held by the Provider be deleted, the LEA shall determine whether the requested deletion would violate State and/or federal records laws. In the event such deletion would not violate State or federal records laws, the LEA shall forward the request for deletion to the Provider. The Provider shall comply with the request and delete the Student Data within a reasonable time period after receiving the request. Any provision of Student Data to the LEA from the Provider shall be transmitted in a format readable by the LEA.

  • Transfer of License Notwithstanding the provisions of conditions 17.1 and 17.2, if Customer sells or transfers the Equipment in which the Software operates, Kodak shall offer to license the Software, and to provide services, to any bona fide end user (“Transferee”) pursuant to Kodak’s then current standard terms, conditions and fees, provided that the Transferee is not considered, in Kodak’s discretion, a competitor of Kodak or its parent, affiliates or subsidiaries. To the extent that the Software is licensed to a Transferee in accordance with this condition, Customer’s license to use the Software shall be deemed terminated. Kodak shall offer to provide de-installation services for the Customer and re-installation and certification for the Equipment and Software and services for the Transferee at Kodak’s then current applicable fees.

  • Specific Provisions for Access Rights to Software For the avoidance of doubt, the general provisions for Access Rights provided for in this Section 9 are applicable also to Software. Parties’ Access Rights to Software do not include any right to receive source code or object code ported to a certain hardware platform or any right to receive respective Software documentation in any particular form or detail, but only as available from the Party granting the Access Rights.

  • Substitution of Concessionaire At any time during the period of Suspension, the Lenders‟ Representative, on behalf of Senior Lenders, shall be entitled to substitute the Concessionaire under and in accordance with the Substitution Agreement, and upon receipt of notice thereunder from the Lenders‟ Representative, the Authority shall withhold Termination for a period not exceeding 180 (one hundred and eighty) days from the date of Suspension, and any extension thereof under Clause 36.1, for enabling the Lenders‟ Representative to exercise its rights of substitution on behalf of Senior Lenders.
