Transmission capacity. 3.1. EUS shall provide to the Shipper on the firm basis the Booked daily transmission capacities at the Entry point Veľké Zlievce as was allocated through the Binding Incremental Capacity Allocation Procedure defined in the Rulebook, and as is specified in the Individual Contract.
3.2. Both Parties shall immediately inform each other about all events which might cause necessary unforeseen changes of the daily quantities or temporary interruption/limitation of the transmission. This applies also for the events of Force Majeure.
3.3. The quantity of Gas for covering operational needs specified in Article 8 of this Contract, if provided in kind, is excluded from the Booked daily transmission capacity.

Transmission capacity. The transmission capacity of the links between the subsystems shall be bilaterally determined on a routine basis by the Parties concerned. Decisions shall normally be based on the operational security standards set out in Appendix 2 and on such current technical and operative factors as are of significance to the transmission capacity. The Parties are individually responsible for assessing these circumstances within their own subsystems and will decide on the necessary measures. The Parties agree to reserve a regulating margin between the transmission and trading capacities of the links. The regulating margin shall normally have the values specified in Appendices 7.1 -7.7.

EBON▇ ▇▇▇l enter into a Transmission Capacity Agreement with HER-I in the form appended hereto as Appendix D (the "TCA") under which HER-I will agree to supply transmission capacity to EBON▇ ▇▇ a value equivalent to ECU 90 million. The ECU 90 million will be paid in cash at the date of signing of the TCA. HER-I's standard terms, including the terms summarized in Appendix E will apply. Capacity on the HER Network, including US connectivity will be available per the HER Ready For Service Date in the TCA. Prices will be as per Schedule 3 of the TCA. The term of the TCA will be 10 years. EBON▇ ▇▇▇l be free to relocate capacity for up to 10 years, both between routes as well as in time (on a monthly basis), except where the Capacity provided is Europe-US.
