Transmission Plan. A document that covers a ten-year horizon and is updated annually by WAPA and includes the following information pertaining to the Desert Southwest Region Systems: A summary of the results of system reliability studies including loadflow, stability, system protection, or other technical studies which are relied upon by WAPA to determine the need for Capital Improvements or Capital RRADs; Other information relied upon by WAPA's Capital Planning Committee (CPC) and/or transmission planners to determine the need for Capital Improvements or Capital RRADs; The results of the AoA process including the alternatives that were studied, the criteria used to assess the technical or financial merits of the alternatives, the recommended Capital Improvement or Capital RRAD, and the reason for the recommendation; A description of demand response alternatives that were studied to mitigate the need for Capital Improvements or Capital RRADs; A list of Capital Improvements proposed to be funded through the Ten-year Planning process; A description of Capital Improvements or Capital RRADs that have been identified to address Project Use Power needs and local area needs, regardless of voltage; Generator interconnections and other transmission facilities that WAPA intends to add as a result of requests made through their OATT process and a discussion of the possible impact of those projects on the capacity of the transmission system; A description of other facilities that are planned to be electrically added to, or interconnected with, the Desert Southwest Region Systems; A summary of Capital Improvements or Capital RRADs that have been submitted to any Regional Planning Organization for further study or incorporation into their models; A description of transmission assets that may be acquired by WAPA or otherwise become part of the Desert Southwest Region Systems through long-term lease arrangements; A discussion of WAPA's future plans to participate in, or become, a Regional Transmission Organization (RTO); Copies of studies conducted, at WAPA's request, by any Regional Planning Organization; and Provided that if any information referenced is considered sensitive, confidential, or otherwise non-public in nature pursuant to any Federal law related to critical infrastructure and security, then the Parties may enter into necessary agreements to protect the sensitivity or confidentiality of information.

Transmission Plan. No later than ten (10) business days prior to the Service Start Date, Customer shall provide Intelsat with a transmission plan (the “Transmission Plan”) which complies with the Operational Requirements. Customer must have Intelsat’s written approval of the Transmission Plan, which approval shall not be unreasonably withheld or delayed, prior to, and as a condition to, Customer’s commencement of the Service. Customer shall also be permitted, subject to Intelsat’s prior written approval, to modify the Transmission Plan from time to time, subject to the terms of the applicable Service Order. Intelsat’s approval of a Transmission Plan shall not constitute, nor does Intelsat make any representation, warranty, or covenant regarding the efficacy of the use of any number of carriers or other alternative uses of the Services. In addition, Intelsat does not make any representation, warranty or covenant regarding the efficacy of any Transmission Plan or use of the Service in relation to potential sources of terrestrial interference, and the absence of terrestrial interference is not a Service Specification.
Transmission Plan. The determination that a transmission addition or upgrade is needed to promote economic efficiency shall be made in any of the following ways:
Transmission Plan. If required by XXXXXX XXXXX, no later than ten (10) days prior to the Service Commencement Date, Customer shall provide XXXXXX XXXXX with a transmission plan (the “Transmission Plan”) which complies with the operational requirements. Customer must have XXXXXX XXXXX’s written approval of the Transmission Plan, which approval shall not be unreasonably withheld or delayed, prior to, and as a condition to, Customer’s commencement of use of the Service. If specified in the Service Agreement, XXXXXX XXXXX will charge a Non-Recurring Connection Fee. Customer shall also be permitted, subject to XXXXXX XXXXX’s prior written approval, to modify the Transmission Plan from time to time; provided, however, that any such changes to the Transmission Plan may require additional Non-Recurring Connection Fees in accordance with XXXXXX XXXXX’s then-current rates for such fees. Unless otherwise set forth in the Service Agreement, or otherwise approved by XXXXXX XXXXX, all transmissions must be in digital format. XXXXXX XXXXX’s approval of a Transmission Plan shall not constitute, nor does XXXXXX XXXXX make, any representation, warranty, or covenant regarding the efficacy of the use of any number of carriers or other alternative uses of the Service.
Transmission Plan. Prior to commencing transmissions to and from the Satellite, Customer shall obtain SES’s prior written approval of its transmission plan. Customer is permitted to modify this transmission plan from time to time. SES makes no representation, warranty, or covenant regarding any use of Transponder capacity provided under any Agreement, including the efficacy of the use of any number of carriers.

Customer may modify the Transmission Plan for the **** Transponders on Galaxy 18 to facilitate emergency provisioning and restoration of services without PanAmSat's prior approval, provided that the uplink power density per carrier into the antenna flange **** and the carriers have the same **** CONFIDENTIAL TREATMENT specifications as those carrier types previously approved. In the event that Customer modifies the Transmission Plan to facilitate emergency provisioning and restoration of services, Customer shall submit a new Transmission Plan to PanAmSat for its approval on the next business day. PanAmSat's approval of a Transmission Plan shall not constitute, nor does PanAmSat make, any representation, warranty, or covenant regarding the efficacy of the use of any number of carriers or other alternative uses of Customer's Transponder Capacity.

Customer shall also be permitted, subject to PanAmSat's prior written approval, to modify the Transmission Plan(s) from time to time. PanAmSat agrees to reply within thirty (30) days of receipt of, and shall not unreasonably withhold its approval of, a transmission plan or modification to such a plan, which approval shall be based solely upon the considerations identified in Section 4.1 below. PanAmSat makes no representation, warranty, or covenant regarding the efficacy of the use of any number of carriers or other alternative uses of capacity provided under this Agreement.
