Transportation Services Equipment. Service Provider shall provide, or cause to be provided, all equipment necessary to perform the Transportation Services. The equipment shall (a) be suitable for the performance of the Transportation Services, (b) comply with the specifications for equipment used for services equivalent to the Transportation Services as required by Applicable Law, including the regulations of the USDOT, and (c) be maintained in a good, safe, and serviceable condition. Service Provider shall only use subcontractors to perform the Transportation Services that maintain a USDOT safety rating of “Satisfactory”.
