Common use of Trial Term Clause in Contracts

Trial Term. 29.01 Where the Employee is awarded a position in a higher classification, they shall serve a three (3) month trial term in that promoted position. During that time, the Employer may return the Employee to their previous position at the same rate of pay they were earning prior to the promotion. 29.02 During the trial period as per Article 29.01, an Employee may choose to return to their previous position at the same rate of pay they were earning prior to the promotion. 29.03 Following the trial period the Employee may request to return to their previous position and if operational requirements permit, the Employer shall allow the Employee to their previous or comparable position at the same rate of pay applicable to the previous position or comparable position at the time they return.
