Common use of True-Up of Actual Costs Clause in Contracts

True-Up of Actual Costs. Within one hundred and twenty (120) calendar days of completing the construction and installation of the EDC’s interconnection facilities and Distribution Upgrades described in the Attachments E and G to this Agreement, the EDC shall provide the Customer-Generator with a final accounting report of any difference between (1) the actual cost incurred to complete the construction and installation and the budget estimate provided to the Customer-Generator and a written explanation for any significant variation; and (2) the Customer-Generator’s previous deposit and aggregate payments to the EDC for such interconnection facilities and distribution upgrades. If the Customer-Generator’s cost responsibility exceeds its previous deposit and aggregate payments, the EDC shall invoice the Customer-Generator for the amount due and the Customer-Generator shall make payment to the EDC within thirty (30) calendar days. If the Customer-Generator’s previous deposit and aggregate payments exceed its cost responsibility under this Agreement, the EDC shall refund to the Customer-Generator an amount equal to the difference within thirty (30) calendar days of the final accounting report.

If the Customer-Generator’s previous deposit and aggregate payments exceed its cost responsibility under this Agreement, the EDC JCP&L shall refund to the Customer-Generator an amount equal to the difference within thirty (30) calendar days of the final accounting report.
