UNAVOIDABLE CANCELLATION Sample Clauses

UNAVOIDABLE CANCELLATION. Contractor reserves the right in its sole discretion to cancel this Agreement including, without limitation, any project site-specific Subcontract Purchase Order, in whole or in part in the event of lockout, strike, unavoidable accident, riot, war, act of God, fire, flood, earthquake, or any other casualty whatsoever affecting Contractor or the project or Contractor’s customer. Such cancellation shall be without penalty to Contractor and subject to Paragraph 15. In no event shall contractor be liable for any incidental, consequential, or special damages or for lost overhead and profit claims for premature cancellation.
