Pending forfeiture, the Advisory Committee, following the expiration of the notice period, may direct the Trustee reallocated pursuant to segregate the Nonforfeitable Accrued Benefit in a segregated Account and to invest that segregated Account in Federally insured interest bearing savings accounts or time deposits (or in a combination of both), or in other fixed income investmentsSection 5.03 hereof. (3) Notwithstanding Subsection 12.06(1) or 12.06(2) above, if upon termination of the Plan Yearand the liquidation of the Trust, then from all or any distribution payable to a Participant or his Beneficiary has not been claimed after sending the amountnotice described in Subsection 12.06(1) above, the Committee shall establish an Individual Retirement Account or an interest-bearing, federally insured account in a bank or savings and loan association in the name of the Participant or Beneficiary, shall purchase a deferred annuity providing the form(s) of benefit prescribed in Article XI or, if any, the Committee is unable to accomplish any of the Trust Fund net income or gain for foregoing, shall dispose of the Participant’s Account in any other method permitted by the Code and ERISA. If a Participant’s Account has been forfeited pursuant to Subsection 12.06(2) above, it shall be restored upon Plan Year termination and then from distributed as provided in the amount, or additional amount, the Employer contributes to enable the Advisory Committee to make the required restorationpreceding sentence.
