Common use of Uncommitted Funding Clause in Contracts

Uncommitted Funding. On expiry or termination of this Agreement, the Ministry may recover any Funding paid to the Recipient, which the Recipient: (i) has not spent or contractually committed to spend in accordance with this Agreement; or (ii) has spent or contractually committed to spend in accordance with this Agreement but which the Recipient can have refunded or released from that commitment, provided the Recipient must use all reasonable endeavours to obtain such refund or release.
