Common use of Underlying Custodial Agreements Clause in Contracts

Underlying Custodial Agreements. With respect to each Pooled Obligor Loan, the underlying loan documents and other collateral pledged by the Underlying Debtors is held by an Underlying Custodian for the benefit of the Originator and its assignees. The Originator’s rights under each such Underlying Custodial Agreement are fully assignable and have been assigned by it to the Trust Depositor, and assigned by the Trust Depositor to the Issuer in connection with the transfer of the Loan Assets.

The Originator’s 's rights under each such Underlying Custodial Agreement are fully assignable and have been assigned by it to the Trust Depositor, and assigned by the Trust Depositor to the Issuer in connection with the transfer of the Loan Assets.
