Common use of Unlawful Use of Service Clause in Contracts

Unlawful Use of Service. Services provided by GTE pursuant to this Agreement shall not be used by First Choice or its end users for any purpose in violation of law. First Choice, and not GTE, shall be responsible to ensure that First Choice and its end users’ use of services provided hereunder comply at all times with all applicable laws. GTE may refuse to furnish service to First Choice or disconnect particular services provided under this Agreement to First Choice or, as appropriate, First Choice's end user when (i) an order is issued by a court of competent jurisdiction finding that probable cause exists to believe that the use made or to be made of the service is prohibited by law or (ii) GTE is notified in writing by a law enforcement agency acting within its jurisdiction that any facility furnished by GTE is being used or will be used for the purpose of transmitting or receiving gambling information in interstate or foreign commerce in violation of law. Termination of service shall take place after reasonable notice is provided to First Choice, or as ordered by the court. If facilities have been physically disconnected by law enforcement officials at the premises where located, and if there is not presented to GTE the written finding of a court, then upon request of First Choice and agreement to pay restoral of service charges and other applicable service charges, GTE shall promptly restore such service.

Unlawful Use of Service. Services provided by GTE pursuant to this Agreement shall not be used by First Choice Suretel or its end users for any purpose in violation of law. First ChoiceSuretel, and not GTE, shall be responsible to ensure that First Choice Suretel and its end users’ use of services provided hereunder comply at all times with all applicable laws. GTE may refuse to furnish service to First Choice Suretel or disconnect particular services provided under this Agreement to First Choice Suretel or, as appropriate, First ChoiceSuretel's end user when (i) an order is issued by a court of competent jurisdiction finding that probable cause exists to believe that the use made or to be made of the service is prohibited by law or (ii) GTE is notified in writing by a law enforcement agency acting within its jurisdiction that any facility furnished by GTE is being used or will be used for the purpose of transmitting or receiving gambling information in interstate or foreign commerce in violation of law. Termination of service shall take place after reasonable notice is provided to First ChoiceSuretel, or as ordered by the court. If facilities have been physically disconnected by law enforcement officials at the premises where located, and if there is not presented to GTE the written finding of a court, then upon request of First Choice Suretel and agreement to pay restoral of service charges and other applicable service charges, GTE shall promptly restore such service.

First ChoiceNOW, and not GTE, shall be responsible to ensure that First Choice NOW and its end users’ use of services provided hereunder comply at all times with all applicable laws. GTE may refuse to furnish service to First Choice NOW or disconnect particular services provided under this Agreement to First Choice NOW or, as appropriate, First ChoiceNOW's end user when (i) an order is issued by a court of competent jurisdiction finding that probable cause exists to believe that the use made or to be made of the service is prohibited by law or (ii) GTE is notified in writing by a law enforcement agency acting within its jurisdiction that any facility furnished by GTE is being used or will be used for the purpose of transmitting or receiving gambling information in interstate or foreign commerce in violation of law. Termination of service shall take place after reasonable notice is provided to First ChoiceNOW, or as ordered by the court. If facilities have been physically disconnected by law enforcement officials at the premises where located, and if there is not presented to GTE the written finding of a court, then upon request of First Choice NOW and agreement to pay restoral of service charges and other applicable service charges, GTE shall promptly restore such service.

Termination of service shall take place after reasonable notice is provided to First ChoicedPi, or as ordered by the court. If facilities have been physically disconnected by law enforcement officials at the premises where located, and if there is not presented to GTE the written finding of a court, then upon request of First Choice dPi and agreement to pay restoral of service charges and other applicable service charges, GTE shall promptly restore such service.

GTE may refuse to furnish service to First Choice eti or disconnect particular services provided under this Agreement to First Choice eti or, as appropriate, First Choiceeti's end user when (i) an order is issued by a court of competent jurisdiction finding that probable cause exists to believe that the use made or to be made of the service is prohibited by law or (ii) GTE is notified in writing by a law enforcement agency acting within its jurisdiction that any facility furnished by GTE is being used or will be used for the purpose of transmitting or receiving gambling information in interstate or foreign commerce in violation of law. Termination of service shall take place after reasonable notice is provided to First Choiceeti, or as ordered by the court. If facilities have been physically disconnected by law enforcement officials at the premises where located, and if there is not presented to GTE the written finding of a court, then upon request of First Choice eti and agreement to pay restoral of service charges and other applicable service charges, GTE shall promptly restore such service.

Unlawful Use of Service. Services provided by GTE pursuant to this Agreement shall not be used by First Choice SUNTEL or its end users for any purpose in violation of law. First ChoiceSUNTEL, and not GTE, shall be responsible to ensure that First Choice SUNTEL and its end users’ use of services provided hereunder comply at all times with all applicable laws. GTE may refuse to furnish service to First Choice SUNTEL or disconnect particular services provided under this Agreement to First Choice SUNTEL or, as appropriate, First ChoiceSUNTEL's end user when (i) an order is issued by a court of competent jurisdiction finding that probable cause exists to believe that the use made or to be made of the service is prohibited by law or (ii) GTE is notified in writing by a law enforcement agency acting within its jurisdiction that any facility furnished by GTE is being used or will be used for the purpose of transmitting or receiving gambling information in interstate or foreign commerce in violation of law. Termination of service shall take place after reasonable notice is provided to First ChoiceSUNTEL, or as ordered by the court. If facilities have been physically disconnected by law enforcement officials at the premises where located, and if there is not presented to GTE the written finding of a court, then upon request of First Choice SUNTEL and agreement to pay restoral of service charges and other applicable service charges, GTE shall promptly restore such service.

Unlawful Use of Service. Services provided by GTE FTC pursuant to this Agreement shall not be used by First Choice FLATEL or its end users for any purpose in violation of law. First Choice, and not GTE, FLATEL shall be responsible to ensure that First Choice FLATEL and its end users’ users use of services provided hereunder comply at all times with all applicable laws. GTE FTC may refuse to furnish service to First Choice FLATEL or disconnect particular services provided under this Agreement to First Choice FLATEL or, as appropriate, First ChoiceFLATEL's end user when (i) an order is issued by a court of competent jurisdiction finding that probable cause exists to believe that the use made or to be made of the service is prohibited by law or (ii) GTE FTC is notified in writing by a law enforcement agency acting within its jurisdiction that any facility furnished by GTE FTC is being used or will be used for the purpose of transmitting or receiving gambling information in interstate or foreign commerce in violation of law. Termination of service shall take place after reasonable notice is provided to First ChoiceFLATEL, or as ordered by the court. If facilities have been physically disconnected by law enforcement officials at the premises where located, and if there is not presented to GTE FTC the written finding of a court, then upon request of First Choice FLATEL and agreement to pay restoral of service charges and other applicable service charges, GTE FTC shall promptly restore such service.

Termination of service shall take place after reasonable notice is provided to First ChoiceDTI, or as ordered by the court. If facilities have been physically disconnected by law enforcement officials at the premises where located, and if there is not presented to GTE the written finding of a court, then upon request of First Choice DTI and agreement to pay restoral of service charges and other applicable service charges, GTE shall promptly restore such service.

First ChoiceGSCOMM, and not GTE, shall be responsible to ensure that First Choice GSCOMM and its end users’ use of services provided hereunder comply at all times with all applicable laws. GTE may refuse to furnish service to First Choice GSCOMM or disconnect particular services provided under this Agreement to First Choice GSCOMM or, as appropriate, First ChoiceGSCOMM's end user when (i) an order is issued by a court of competent jurisdiction finding that probable cause exists to believe that the use made or to be made of the service is prohibited by law or (ii) GTE is notified in writing by a law enforcement agency acting within its jurisdiction that any facility furnished by GTE is being used or will be used for the purpose of transmitting or receiving gambling information in interstate or foreign commerce in violation of law. Termination of service shall take place after reasonable notice is provided to First ChoiceGSCOMM, or as ordered by the court. If facilities have been physically disconnected by law enforcement officials at the premises where located, and if there is not presented to GTE the written finding of a court, then upon request of First Choice GSCOMM and agreement to pay restoral of service charges and other applicable service charges, GTE shall promptly restore such service.

GTE may refuse to furnish service to First Choice PHNLK or disconnect particular services provided under this Agreement to First Choice PHNLK or, as appropriate, First ChoicePHNLK's end user when (i) an order is issued by a court of competent jurisdiction finding that probable cause exists to believe that the use made or to be made of the service is prohibited by law or (ii) GTE is notified in writing by a law enforcement agency acting within its jurisdiction that any facility furnished by GTE is being used or will be used for the purpose of transmitting or receiving gambling information in interstate or foreign commerce in violation of law. Termination of service shall take place after reasonable notice is provided to First ChoicePHNLK, or as ordered by the court. If facilities have been physically disconnected by law enforcement officials at the premises where located, and if there is not presented to GTE the written finding of a court, then upon request of First Choice PHNLK and agreement to pay restoral of service charges and other applicable service charges, GTE shall promptly restore such service.

First ChoiceLONE STAR, and not GTE, shall be responsible to ensure that First Choice LONE STAR and its end users’ use of services provided hereunder comply at all times with all applicable laws. GTE may refuse to furnish service to First Choice LONE STAR or disconnect particular services provided under this Agreement to First Choice LONE STAR or, as appropriate, First ChoiceLONE STAR's end user when (i) an order is issued by a court of competent jurisdiction finding that probable cause exists to believe that the use made or to be made of the service is prohibited by law or (ii) GTE is notified in writing by a law enforcement agency acting within its jurisdiction that any facility furnished by GTE is being used or will be used for the purpose of transmitting or receiving gambling information in interstate or foreign commerce in violation of law. Termination of service shall take place after reasonable notice is provided to First ChoiceLONE STAR, or as ordered by the court. If facilities have been physically disconnected by law enforcement officials at the premises where located, and if there is not presented to GTE the written finding of a court, then upon request of First Choice LONE STAR and agreement to pay restoral of service charges and other applicable service charges, GTE shall promptly restore such service.

Unlawful Use of Service. Services provided by GTE pursuant to this Agreement shall not be used by First Choice Prepaid or its end users for any purpose in violation of law. First ChoicePrepaid, and not GTE, shall be responsible to ensure that First Choice Prepaid and its end users’ users use of services provided hereunder comply at all times with all applicable laws. GTE may refuse to furnish service to First Choice Prepaid or disconnect particular services provided under this Agreement to First Choice Prepaid or, as appropriate, First ChoicePrepaid's end user when (i) an order is issued by a court of competent jurisdiction finding that probable cause exists to believe that the use made or to be made of the service is prohibited by law or (ii) GTE is notified in writing by a law enforcement agency acting within its jurisdiction that any facility furnished by GTE is being used or will be used for the purpose of transmitting or receiving gambling information in interstate or foreign commerce in violation of law. Termination of service shall take place after reasonable notice is provided to First ChoicePrepaid, or as ordered by the court. If facilities have been physically disconnected by law enforcement officials at the premises where located, and if there is not presented to GTE the written finding of a court, then upon request of First Choice Prepaid and agreement to pay restoral of service charges and other applicable service charges, GTE shall promptly restore such service.

Unlawful Use of Service. Services provided by GTE pursuant to this Agreement shall not be used by First Choice EZ Talk or its end users for any purpose in violation of law. First ChoiceEZ Talk, and not GTE, shall be responsible to ensure that First Choice EZ Talk and its end users’ users use of services provided hereunder comply at all times with all applicable laws. GTE may refuse to furnish service to First Choice EZ Talk or disconnect particular services provided under this Agreement to First Choice EZ Talk or, as appropriate, First ChoiceEZ Talk's end user when (i) an order is issued by a court of competent jurisdiction finding that probable cause exists to believe that the use made or to be made of the service is prohibited by law or (ii) GTE is notified in writing by a law enforcement agency acting within its jurisdiction that any facility furnished by GTE is being used or will be used for the purpose of transmitting or receiving gambling information in interstate or foreign commerce in violation of law. Termination of service shall take place after reasonable notice is provided to First ChoiceEZ Talk, or as ordered by the court. If facilities have been physically disconnected by law enforcement officials at the premises where located, and if there is not presented to GTE the written finding of a court, then upon request of First Choice EZ Talk and agreement to pay restoral of service charges and other applicable service charges, GTE shall promptly restore such service.

Unlawful Use of Service. Services provided by GTE pursuant to this Agreement shall not be used by First Choice RECONEX or its end users for any purpose in violation of law. First Choice, RECONEX and not GTE, shall be responsible to ensure that First Choice RECONEX and its end users’ users use of services provided hereunder comply at all times with all applicable laws. GTE may refuse to furnish service to First Choice RECONEX or disconnect particular services provided under this Agreement to First Choice RECONEX or, as appropriate, First ChoiceRECONEX's end user when (i) an order is issued by a court of competent jurisdiction finding that probable cause exists to believe that the use made or to be made of the service is prohibited by law or (ii) GTE is notified in writing by a law enforcement agency acting within its jurisdiction that any facility furnished by GTE is being used or will be used for the purpose of transmitting or receiving gambling information in interstate or foreign commerce in violation of law. Termination of service shall take place after reasonable notice is provided to First ChoiceRECONEX, or as ordered by the court. If facilities have been physically disconnected by law enforcement officials at the premises where located, and if there is not presented to GTE the written finding of a court, then upon request of First Choice RECONEX and agreement to pay restoral of service charges and other applicable service charges, GTE shall promptly restore such service.

Unlawful Use of Service. Services provided by GTE pursuant to this Agreement shall not be used by First Choice ANNOX or its end users for any purpose in violation of law. First ChoiceANNOX, and not GTE, shall be responsible to ensure that First Choice ANNOX and its end users’ use of services provided hereunder comply at all times with all applicable laws. GTE may refuse to furnish service to First Choice ANNOX or disconnect particular services provided under this Agreement to First Choice ANNOX or, as appropriate, First ChoiceANNOX's end user when (i) an order is issued by a court of competent jurisdiction finding that probable cause exists to believe that the use made or to be made of the service is prohibited by law or (ii) GTE is notified in writing by a law enforcement agency acting within its jurisdiction that any facility furnished by GTE is being used or will be used for the purpose of transmitting or receiving gambling information in interstate or foreign commerce in violation of law. Termination of service shall take place after reasonable notice is provided to First ChoiceANNOX, or as ordered by the court. If facilities have been physically disconnected by law enforcement officials at the premises where located, and if there is not presented to GTE the written finding of a court, then upon request of First Choice ANNOX and agreement to pay restoral of service charges and other applicable service charges, GTE shall promptly restore such service.

First ChoiceUSTELCOM, and not GTE, shall be responsible to ensure that First Choice USTELCOM and its end users’ users use of services provided hereunder comply at all times with all applicable laws. GTE may refuse to furnish service to First Choice USTELCOM or disconnect particular services provided under this Agreement to First Choice USTELCOM or, as appropriate, First ChoiceUSTELCOM's end user when (i) an order is issued by a court of competent jurisdiction finding that probable cause exists to believe that the use made or to be made of the service is prohibited by law or (ii) GTE is notified in writing by a law enforcement agency acting within its jurisdiction that any facility furnished by GTE is being used or will be used for the purpose of transmitting or receiving gambling information in interstate or foreign commerce in violation of law. Termination of service shall take place after reasonable notice is provided to First ChoiceUSTELCOM, or as ordered by the court. If facilities have been physically disconnected by law enforcement officials at the premises where located, and if there is not presented to GTE the written finding of a court, then upon request of First Choice USTELCOM and agreement to pay restoral of service charges and other applicable service charges, GTE shall promptly restore such service.

First ChoicePCS, and not GTE, shall be responsible to ensure that First Choice PCS and its end users’ users use of services provided hereunder comply at all times with all applicable laws. GTE may refuse to furnish service to First Choice PCS or disconnect particular services provided under this Agreement to First Choice PCS or, as appropriate, First ChoicePCS's end user when (i) an order is issued by a court of competent jurisdiction finding that probable cause exists to believe that the use made or to be made of the service is prohibited by law or (ii) GTE is notified in writing by a law enforcement agency acting within its jurisdiction that any facility furnished by GTE is being used or will be used for the purpose of transmitting or receiving gambling information in interstate or foreign commerce in violation of law. Termination of service shall take place after reasonable notice is provided to First ChoicePCS, or as ordered by the court. If facilities have been physically disconnected by law enforcement officials at the premises where located, and if there is not presented to GTE the written finding of a court, then upon request of First Choice PCS and agreement to pay restoral of service charges and other applicable service charges, GTE shall promptly restore such service.

First ChoiceJTC, and not GTE, shall be responsible to ensure that First Choice JTC and its end users’ users use of services provided hereunder comply at all times with all applicable laws. GTE may refuse to furnish service to First Choice JTC or disconnect particular services provided under this Agreement to First Choice JTC or, as appropriate, First ChoiceJTC's end user when (i) an order is issued by a court of competent jurisdiction finding that probable cause exists to believe that the use made or to be made of the service is prohibited by law or (ii) GTE is notified in writing by a law enforcement agency acting within its jurisdiction that any facility furnished by GTE is being used or will be used for the purpose of transmitting or receiving gambling information in interstate or foreign commerce in violation of law. Termination of service shall take place after reasonable notice is provided to First ChoiceJTC, or as ordered by the court. If facilities have been physically disconnected by law enforcement officials at the premises where located, and if there is not presented to GTE the written finding of a court, then upon request of First Choice JTC and agreement to pay restoral of service charges and other applicable service charges, GTE shall promptly restore such service.

First ChoiceCCI, and not GTE, shall be responsible to ensure that First Choice CCI and its end userscustomers’ use of services provided hereunder comply at all times with all applicable laws. GTE may refuse to furnish service to First Choice CCI or disconnect particular services provided under this Agreement to First Choice CCI or, as appropriate, First ChoiceCCI's end user customer when (i) an order is issued by a court of competent jurisdiction finding that probable cause exists to believe that the use made or to be made of the service is prohibited by law or (ii) GTE is notified in writing by a law enforcement agency acting within its jurisdiction that any facility furnished by GTE is being used or will be used for the purpose of transmitting or receiving gambling information in interstate or foreign commerce in violation of law. Termination of service shall take place after reasonable notice is provided to First ChoiceCCI, or as ordered by the court. If facilities have been physically disconnected by law enforcement officials at the premises where located, and if there is not presented to GTE the written finding of a court, then upon request of First Choice CCI and agreement to pay restoral of service charges and other applicable service charges, GTE shall promptly restore such service.
